In her testimony on Friday, Ms. Malandri denied the prostitution allegations and only admitted that she gave the undercover officer an "air dance": "I was on top of him. I was touching him on his arms and chest."
Rodriguez's New York criminal defense lawyer said that the two women thought that the threesome offer was "a joke.. I mean, $5,000!" (The New York Post). He went on to say that they "played along" with it, but they never acted on it. When they were arrested a month after the conversation, the threesome had no occurred.
The former owner of the club, Louis Posner, is going to trial on April 1 for charges that he was running a brothel (The Gothamist). If both of the women are cleared of the prostitution charges, it might help Posner's case.
