Both of the dancers that were up against prostitution charges are free. Falynn Rodgriguez, 26, was released because the judge ruled that there was not enough evidence against her (). On Tuesday, Cassandra Malandri, 26, also known as Alexia Moore, was found not guilty (). Both worked at the Manhattan Hot Lap Dance Club in 2008 as dancers and were accused of offering an undercover cop a threesome for $5,000.

In her testimony on Friday, Ms. Malandri denied the prostitution allegations and only admitted that she gave the undercover officer an "air dance": "I was on top of him. I was touching him on his arms and chest."

Rodriguez's New York criminal defense lawyer said that the two women thought that the threesome offer was "a joke.. I mean, $5,000!" (). He went on to say that they "played along" with it, but they never acted on it. When they were arrested a month after the conversation, the threesome had no occurred.

The former owner of the club, Louis Posner, is going to trial on April 1 for charges that he was running a brothel (). If both of the women are cleared of the prostitution charges, it might help Posner's case.
