Here's one for New York criminal defense lawyers-- a spa owner is being charged with assault and unlawful practice of medicine after she nearly killed a woman while giving her a butt implant.
The 27 year old woman, Barbara Nieto, was charged on Friday after customer Augusta Velez almost died of a life-threatening infection.
Augusta Velez, 23, had a butt augmentation procedure performed at Nieto's Perfect Image Stethics in Corona. She had fat removed from her stomach and had the fat injected into her buttocks, according to Queens prosecutors. The $500 procedure took place on March 20. Augusta Velez was scheduled to return for an additional visit for a massage. However, she never came for the massage because she drew a very high fever and suffered intense pain.
Doctors found abscesses on Augusta Velez's buttocks. As a result, Augusta Velez required surgery.
But according to the NY Daily News, this isn't the first time that Barbara Nieto has been responsible for the alleged misconduct.
In a separate case stemming from a butt augmentation at her alleged Elmhurst spa Bell Stetika, Tania Solis sued the spa for the injuries she sustained as a result of the butt enhancement treatment she received. The New York Criminal Law Blog has not yet confirmed the NY Daily News claim that Barbara Nieto was the owner of Bell Stetika.
As the old adage goes, "res ipsa loquitor," or "the thing speaks for itself" will most likely come into play. And with any luck, the prosecution will be able to show Barbara Nieto's history of misconduct and reckless behavior-- and let the facts speak for itself in terms of liability.
And while the res ipsa doctrine is largely used in tort law, Barbara Nieto's New York criminal defense attorneys have their work cut out for them. If more Tania Solises and Augusta Velezes emerge out of the woodwork, it may become very difficult for Barbara Nieto's New York criminal defense lawyers to make their case.
